Jean-Claude Juncker is wrong and dangerously out of touch to demand an immediate Brexit
The EU referendum has turned UK politics on its head, with one and possibly two party leaders being sacrificed, a new Prime Minister in the pipeline, Scotland’s leader seeking a second independence referendum, and even the question of Irish reunification back on the agenda. The President of the European Commission, Jean Claude Juncker has suggested that the UK should ‘Brexit’ as soon as possible, in order to avoid further uncertainty. Here, Sean Swan argues that this position is dangerously wrong.
The President of the European Commission, Jean-Claude Juncker, wants the UK out of the EU immediately. His reasoning is, doubtlessly, to take a hardline with the UK pour encourager les autres. Let other EU member states contemplating an exit take heed and tremble as the UK is given a punishment beating! This may be the diktat of a high handed elitist or the pouting of a frustrated child, but what it most definitely is not is the stance of a statesman. The referendum result happened for a reason, a majority of the people are unhappy with UK membership of the EU as it currently exists. Juncker is going for the doomsday ‘out’ option on this rather than seek to understand why people are discontented and seeking to address their concerns. This referendum result can – and should be – seen as a demand for reform. If Juncker assumes the stance of some latter day Nicolae Ceaușescu, he may well intimidate some into compliance in the short term, but he will also further stoke Euroscepticism. This is a stupid, short-sighted and doomed policy.
Let nobody be deluded about what is happening here. We may be witnessing a sort of western 1989. The collapse of both the EU and the UK is now a real possibility. Perhaps it will be relatively orderly as in the case of the Eastern Bloc, but maybe it will take on aspects of the collapse of Yugoslavia. Think it could never happen here? A referendum on Irish unity could spark off conflict in Northern Ireland, even Scottish independence is a bitterly divisive issue. Think on. Think Spain, think Belgium. Unthinkable? Yes, but everything is unthinkable – right up to the moment it becomes inevitable. Even as things stand, the political divisions not just between England and other parts of the UK but within England itself are dangerous an inflamed.
At the moment there is a British government which is pro-EU. Negotiation is possible. Even a second referendum on reformed membership is possible. Halting the exit process to allow time for reflection and negotiation is still possible – in fact, it’s necessary. It would take the heat and immediacy out of calls for Scottish independence, a united Ireland and London independence. This does not constitute ignoring the referendum result, it means taking it very seriously. Nobody doubts that the heart of the Out vote was a working-class revolt. It has as much to do with the failed economic policies of austerity and neoliberalism and its resultant hardships and insecurities as with the mechanisms of the EU itself. The fact that this mood was ignored by the left – who should have led it in some productive reforming direction – only to be finally captured by UKIP and the Tory right is but one of the bitter ironies of this situation. Those gunning for Corbyn now may be right, but Corbyn’s failure was not, as some unreconstructed Blairites insinuate, that he was too left-wing. If anything, he was not left wing enough. Corbyn’s response to the referendum should have been a cry of ‘a pox on both your houses!’, this is an internal Tory feud, this referendum is unnecessary. What is necessary are economic reforms both in the UK and in the EU – so vote Remain but remember that you should not even have to answer this question because it should not have been asked. The real questions are jobs, wages, hospitals and housing – and an end to austerity.
Brexit, particularly a Brexit based on the extremist economic policies of the free market fundamentalists of Economists for Brexit, offers nothing to the English working-class except the destruction of British industry and a move to a 100% service based economy. How does a future frying burgers in McDonalds sound? And that would be the privileged position of those luck enough to find a job. There must be reforms, including economic reforms, and those reforms require a reformed UK within a reformed EU. The alternative is as stark as it is simple – no EU and no UK.
Juncker must change his tone and his posture, and if he refuses to do so, it falls to the leaders of other member states and to the EU Parliament to help him see the error of his ways. In the final analysis it may fall to the people of Europe themselves to make their voices heard on this issue. This is not funny anymore.

Seriously? The whole world begged you not to do it, the likes of Wilders and LePen aside. Everybody, including Juncker, told you that it was a really bad idea. But Britain is the pouting frustrated child now. Since your government chose to honour the outcome of the referendum, there is not much Juncker can do. It was decided democraticaly wasn’t it. It is not up to Juncker but up to your government and countrymen to change your tone and posture. Your government should say that they will take the referendum as a signal in stead of a marching order. And use the Dutch referendum as another signal as well for all I care. And use it to talk about reforms that would make Britain stay in the EU. But you will really have to take the first step. You pissed in your own boots. Feels nice and warm for a second, but in the end leaves you with cold and wet feet. Don’t blame the rest of Europe for that.

If you look at Article 50 of Lisbon Treaty (https://www.lisbon-treaty.org/wcm/the-lisbon-treaty/treaty-on-European-union-and-comments/title-6-final-provisions/137-article-50.html), you will note that there is actually no role for the Commission in this.
The negotiations are to be conducted by the European Council and once concluded, the end result has to be approved by the European Parliament.
I have not studied the constitutional settlement since the 1990s, but I do no recall any formal statement as to separation of powers. However, since the institutions are creatures of the Treaties, it is difficult to see how they can legitimately extend beyond the roles assigned to them by the treaties.
In that reading, Mr Juncker has no authority to make these demands, and may be acting outside his remit to do so.
Having said all that, I am advised by an MEP that it is expected that the Commission would be involved in any negotiations on exit. This is perhaps for reasons of practicability rather than entitlement.

The reaction if Junker was that of a spoiled brat who has not got his own way.Instead of acknowledging that there are huge faults with the EU least of which is its lack if democracy ,he should be looking for ways to not only keep Britain inside the EU but also ways of satisfying all our friends and colleagues sacross Europe who are equally disgruntled.If he. The Brexit is intensified due to the immigration crisis in the Europe, and the immigration issue of hundreds of thousands war torn refugees from Syria, Iraq, Afghanistan and Libya rushing to the Europe to save their lives and humanity, was the product of the wars, which were wedged by America and her Hawkish leaders and neo cons to change the regimes to continue her world supremacy , super power status and above all economy.
Terrorism, Brexit, collapse of the global economy and misery for millions of human beings are the latest bye-products of these wars, and America and her Presidents should be held responsible for these sufferings, and solutions too.
Sean Swan is right, but also wrong. A smaller matter that he has forgotten to take into account is that, 41 years ago, the British people were lied to. One part of that lie was the leaflet issued to all households talking about the massive Soviet tank armies flooding across Europe and, unlike the nazis, not stopping at the English Channel. Best to be part of a group of countries that could fight together, they said. Conveniently forgetting to mention NATO. No loss of sovereignty, they said. Just like EFTA but bigger, they said. All lies. Seeing the metamorphosis of the EEC into the EC and then the EU, the British people have decided to put matters right. Some people might like to spend the time to research comments made, over time, by people like Schulz and Juncker. The EU “leadership” might, belatedly, consider that the largest part of the UK population is English. It’s about ten times the size of any other constituent part. Never a good idea to “push” the English. That it’s only now that the “leadership” has admitted that the population of the EU may not have the same “vision” as the politicians. How many other “members” will hold referendums and vote to leave
EU politicians are so blinkered. In their eyes, the world starts and ends with the “single market”. And yet, outside of the EU, there are 179 other countries that the UK can trade with. It can even trade with the EU members under the GATT. Try to stop that and the EU could find itself on the defensive before the WTO.
For hundreds of years Britain was a trading nation. It was fooled into thinking that the EEC would be just a trading bloc. There was no intention on the part of the British people to join a bloc intent on power. It’s tried to be a European version of the UN. Except that the UN General Assembly has no authority to force members to comply. Between the European Commission and the European Parliament, the EU has taken that authority. Even worse, it uses it. It’s trying to take the role occupied by NATO. Which member states are going to hand over control of their armed forces? In 2011, following the Libyan civil war, van Rompuy tried to claim credit for the actions of EU members. He was quickly, and publicly, slapped down with politicians pointing out the involvement of non-members and the refusal of a number of members to take part at all. But it showed the way the European Council was thinking. It’s notable that the individual that speaks most often speaks for the EU is Juncker, President of the European Commission, rather than Tusk, President of the European Council.
And these are all things that the British people noted. Of course there was a split. A week or so ago, a group of “young” MPs issued a letter. It sought to say that a vote for Brexit was a vote discriminating against the young people of our country. They trotted out the priorities of young people. Mobile phone charges, air fares and the cost of downloading films. These were the “priorities” everyone else had to take into account? Set out in writing by a group of people entrusted with the government of our country? These are the sort of people that ought be removed from any position of authority as soon as possible. Now that Brexit HAS been voted for, it is to be hoped that they will resign their seats as soon as possible.
